Inadditiontothat, thefactthatRussiahas
acknowledgedChinaamarketeconomycountrymakes
it impossibletoapplywithintheCustomsUnionthe
samemethodsofcalculationsofantidumpingand
compensatorydutiesUSAapply in investigations
againstChina.Whenconducting investigationsor in
attemptsofadoptingmeasuresofnon-tariffregulations
it isextremelydifficulttocalculatethecostofproducts
manufactured inChinaforthemethodsofprice-
formingused inothercountries,say,Germany,USA,
EU,cannotbeapplied inRussia.Chinesetubescannotbe
suppliedtoUSA,EUorCanadawherehighprotective
importdutiesonthistypeofproductsareapplied.Since
Russiadoesnotpractice it,Chinesetubesarewidely
imported inRussiaandthewholeCustomsUnion.
According toTubes IndustryDevelopment
Foundation, oneof a few solutions to thisproblem
couldbeestablishinga statisticsportalwhichwould
provideRussian,Belorussian, andKazakhstan
producersanaccurateandcomprehensive
informationon tubularproducts import-export
flows, customsvalue, and thirdcountries’ rateof
consumption, inotherwords, information sufficient
for the initiationof an investigation.Tubes Industry
DevelopmentFoundationandRussianSteel
extensivelypromote thismeasure in theMinistryof
EconomicDevelopmentof theRussianFederation,
Ministryof IndustryandTradeof theRussian
Federation, and theEurasianEconomicCommittee.
O.Kalinskygavean interestingexampleof tricks
usedby tubesmarketplayerswhenexporting their
products to theCustomsUnioncountries.Thus, a
quotaofabout26kt/yhasbeenadoptedonsuppliesof
Chinesecold-formedstainless tubes toRussia.After
thequotahasbeenappliedsuppliesof this typeof
products fromChina toRussiareduced(diagram4).
Supplies toMalaysia,on thecontrary, increased
considerably.According toa free trade treatysigned
betweenMalaysiaandChina, the lattercanenjoy
exemption from importduties.Afterawhile,however,
Malaysian import toRussia increased.
SinceMalaysiadoesnothavemany tubes-making
facilities, their importvolume toRussiasince2010
cannotbecompared to theirproductioncapacity.This
isagoodexampleofprotectivemeasuresevading.
OnNovember2013EurasianEconomicCommittee
madeadecision to legallyprotectMalaysiansuppliers.
This isoneofgoodexamplesofcooperationbetween
Russian tubesproducers,Tubes IndustryDevelopment
Foundation, andEurasianEconomicCommittee.
Tubes IndustryDevelopmentFoundation together
with itscolleagues from thegovernmentkeeps
adoptingmeasureson improvingmechanismsof
