mainlydealswith introducing retroactivemeasures
in theRussianandCustomsUnionmembers’
legislature, shortening investigationperiods, anda
moreefficientuseofpreliminarymeasures.After
theFoundation received suchacommission from
TheChairmanof theGovernmentof theRussian
Federation ithasmade theprepositions toEurasian
EconomicCommitteeonadopting suchmeasures
in the legislature. Inparallel to that, theFoundation
negotiateswithBelarusandKazakhstanonadopting
the retroactivemeasures in their legislaturewith their
furtherapplicationsby theCustomsUnion.
Inmanydevelopedcountries,WTOmembers,
retroactivemeasureswereadopted in legislature
longago.As soonasacompensatoryorantidumping
investigationhasbeen initiated, importersare
promptly informedabout it. Incase retroactive
measuresarenot found in the legislature, importers
stillhaveapossibility to supply theirproducts
evenafter the investigationhasbeen initiateduntil
preliminarymeasuresareappliedor the investigation
iscompleted.Then theproductsaredelivered to
thewarehouseor soldat lowprices. If retroactive
measuresare found in the legislature, adutymay
be imposedon the import supplies some timeafter
the investigationhasbeen initiated.Thus, inorder
toprotect thedomesticmarket and itsproducers, a
possibilityofmass importsafter the initiationof the
investigation is intercepted.
Todaysome35applicationsonestablishing free
tradezonesbetween theCustomsUnionmembers
andothercountrieshavebeenreceived,which ina
sense threatens thedomesticmarket.Diving into
establishingsuch free tradezoneswemayaffect the
whole industry for importedproductshard tobe
protected fromcanenter thedomesticmarket through
othercountries,membersof theCustomsUnion.
Thismayaffectnotonly thesteel,butalso textile,
agriculture, constructionandmanymore industries.
Among thecountriesvoting for the free trade
are thosehavingexcess facilitiesconsiderably
overlappingdomesticconsumption.TheFoundation
hasalwayspursued thepolicyof taking restrictions
on thosehavingexcess tubes-making facilities risking
toenter theRussianmarketwith theirproducts.This
willhelpRussian tubescompaniescompetemore
efficientlynotgetting into the situationwhenwehelp
foreign rather thandomesticproducers.
Speakingaboutanunfaircompetition,wemeannot
onlyunsanctioned imports toRussiaand theCustoms
Unioncountries forunfaircompetitioncanbe found
in thedomesticmarketawell. Insteadofnew tubes,
usedor theso-calledreconditionedonesareoften
installed.Theyaresoldasnewonesat thepricesofnew
tubes.Afterbeing installed in thepipelinesucha tube
burstsunderpressureorextreme temperaturescausing
anemergencysituation.TheFoundation togetherwith
othercompaniesstarteddealingwith thisproblemfive
yearsago.The total economicdamage from theuse
of such tubesreachedmore than6bnrubles in2013.
Today therearenoclearprovisions in the legislature
whichcouldrestrict theuseof such typeofproducts.
